1. Application of These Terms

These Terms and Conditions of Entry apply to all persons who purchase, receive or use a ticket to Santa’s Wonderland, enter Santa’s Wonderland, or participate in any ride, attraction, show, activity or event area.

By purchasing, receiving or using a ticket, entering Santa’s Wonderland, or participating in any Attraction, each patron agrees to comply with:

  1. these Terms and Conditions of Entry;

  2. the Santa’s Wonderland Release and Waiver: Release and Waiver;

  3. the Santa’s Wonderland Privacy Policy: Privacy Policy;

  4. the Santa’s Wonderland Inclusion and Accessibility Policy;

  5. the Santa’s Wonderland Rules & Regulations for Rides;

  6. all displayed signs, safety notices and operator instructions; and

  7. all applicable laws, regulations, health orders, directions and government mandates.

If there is any inconsistency between these Terms and a ride-specific safety rule, operator instruction or displayed safety requirement, the more specific safety requirement applies.

2. Definitions

In these Terms:

Attractions means rides, ice skating, tobogganing, jumping castles, ball crawl, selfie stops, interactive activities, stage shows, amusement rides, photo opportunities, event installations and any other activities or event areas operated or made available at Santa’s Wonderland.

Operator instructions means all verbal directions, written rules, safety signs, ride-specific restrictions, manufacturer requirements and directions given by Santa’s Wonderland staff, contractors, operators, stewards, security personnel or officials.

Responsible adult means a parent, guardian, carer or other adult aged 18 years or over who is responsible for supervising a child or dependant.

Santa’s Wonderlandweus and our means Santa’s Wonderland and its related entities, officers, employees, contractors, operators, agents and authorised representatives.

3. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and applicable State or Territory fair trading legislation.

Any limitation or exclusion of liability in these Terms applies only to the maximum extent permitted by law.

4. Tickets and Admission

Admission to Santa’s Wonderland is subject to ticket validity, session capacity, these Terms and all applicable laws and safety requirements.

Tickets must:

  1. be original, valid and lawfully obtained;

  2. be issued through an authorised ticketing channel;

  3. display or correspond with the correct session time and date;

  4. be presented on entry, either physically or digitally as applicable; and

  5. not be altered, duplicated, transferred or used fraudulently.

Photo identification may be required on request.

Santa’s Wonderland may refuse entry where a ticket is fraudulent, duplicated, altered, unlawfully obtained, used contrary to the applicable ticketing terms, or otherwise invalid. Fraudulent ticket use may be referred to police or other relevant authorities.

5. Admission Inclusions and Exclusions

The admission price includes access to rides, shows and Attractions included in the relevant ticket type.

Unless expressly included in the ticket type, the admission price does not include:

  1. food or beverages;

  2. merchandise;

  3. photo sessions;

  4. pay-per-use facilities, including skill games and video games;

  5. optional add-on experiences;

  6. private bookings or premium experiences; and

  7. any other product or service identified as an additional cost.

6. Session Times, Capacity and Operational Changes

Published session times, Attractions, shows and operating schedules may vary.

Santa’s Wonderland may change, delay, suspend, substitute or cancel sessions, rides, Attractions or shows for reasons including:

  1. safety;

  2. maintenance;

  3. technical issues;

  4. weather;

  5. staffing;

  6. crowd management;

  7. capacity limits;

  8. operational requirements;

  9. emergency circumstances;

  10. government or regulatory directions; or

  11. circumstances beyond Santa’s Wonderland’s reasonable control.

Santa’s Wonderland will provide reasonable notice where practicable. Sessions may be marked as sold out once capacity is reached.

Any rights to refunds, exchanges or other remedies are subject to the Australian Consumer Law and the applicable ticketing terms.

7. Children and Supervision

Santa’s Wonderland may deny admission to any person under the age of 14 unless accompanied by a responsible adult.

Children and dependants must be supervised by a responsible adult at all times.

A responsible adult must:

  1. remain responsible for the conduct and safety of children and dependants under their care;

  2. ensure children and dependants comply with these Terms, displayed signs and operator instructions;

  3. assess whether each child or dependant can safely participate in an Attraction;

  4. remain at or near ride entry and exit points where required; and

  5. participate with or directly supervise a child where required by an Attraction’s safety rules.

Failure to properly supervise children or dependants may result in refusal of entry, refusal of participation in Attractions, or removal from Santa’s Wonderland.

8. Ride and Attraction Safety

For the safety of all patrons, some Attractions are subject to age, height, weight, mobility, footwear, health, capacity, supervision or other safety restrictions.

Participation in any Attraction is subject to:

  1. displayed safety signs;

  2. operator instructions;

  3. manufacturer and operator requirements;

  4. the patron’s individual circumstances;

  5. the safe operation of the Attraction; and

  6. the discretion of the relevant operator, exercised for safety or operational reasons.

Santa’s Wonderland may refuse participation in, or remove a patron from, any Attraction where reasonably necessary for safety, security or operational reasons.

9. Health, Fitness and Capacity to Participate

Patrons must not participate in an Attraction if participation may be unsafe due to:

  1. pregnancy;

  2. injury;

  3. illness;

  4. medical condition;

  5. disability or mobility limitation that affects safe participation;

  6. heart, back, neck, bone or joint condition;

  7. recent surgery;

  8. dizziness, fainting, seizures or balance issues;

  9. medication that may impair participation;

  10. fatigue;

  11. intoxication; or

  12. any other condition that may be aggravated by the Attraction.

Patrons are responsible for assessing whether they, and any child or dependant under their supervision, can safely participate in an Attraction.

10. Footwear and Clothing

Appropriate clothing and footwear must be worn at all times, except where removal of loose footwear is required for a specific Attraction.

Appropriate footwear is required for all ice skating activities, ice slides and other Attractions where footwear requirements are displayed or communicated by staff or operators.

Santa’s Wonderland may refuse participation in an Attraction where a patron’s footwear, clothing or accessories create a safety risk.

11. Dangerous Recreational Activities and Release and Waiver

Certain Attractions, including ice skating, jumping castles, tobogganing, amusement rides and similar activities, may be recreational activities or dangerous recreational activities.

These activities involve inherent and obvious risks, including risk of accident, property damage, physical or mental injury, serious injury and death.

By purchasing, receiving or using a ticket, entering Santa’s Wonderland or participating in any Attraction, each patron acknowledges and agrees to the Santa’s Wonderland Release and Waiver: Release and Waiver.

Where a responsible adult purchases, receives or uses a ticket for a child or dependant, or permits a child or dependant to enter Santa’s Wonderland or participate in an Attraction, the responsible adult gives the acknowledgements in the Release and Waiver on their own behalf and, to the extent permitted by law, on behalf of the child or dependant.

12. Prohibited Items

The following items must not be brought into Santa’s Wonderland unless expressly authorised:

  1. alcohol;

  2. illicit drugs or prohibited substances;

  3. glassware or glass containers;

  4. knives, blades or sharp objects;

  5. weapons or items that may be used as weapons;

  6. fireworks, flares, smoke canisters or explosives;

  7. air-horns, laser devices or similar nuisance devices;

  8. drones or remotely operated devices;

  9. frisbees, balls, inflatables or other devices that may jeopardise safety or impede staff;

  10. scooters, skateboards, bicycles, roller blades or other equipment that may interfere with pedestrian traffic;

  11. dangerous, hazardous or flammable items;

  12. opened bottles of drink or liquid, unless permitted by Santa’s Wonderland;

  13. poles or large structures;

  14. animals other than accredited assistance animals; and

Santa’s Wonderland may refuse entry, require removal of prohibited items, or remove a patron from the event where a prohibited item is brought into Santa’s Wonderland.

13. Alcohol, Drugs and Intoxication

No alcohol may be brought into Santa’s Wonderland.

No illicit drugs or prohibited substances may be brought into Santa’s Wonderland.

Santa’s Wonderland may refuse entry to, refuse service to, refuse participation by, or remove any patron who Santa’s Wonderland reasonably believes is affected by alcohol or drugs, or whose conduct creates a safety or security risk.

14. Assistance Animals

Accredited assistance animals are permitted at Santa’s Wonderland, subject to legitimate safety requirements for particular Attractions and event areas.

For safety reasons, an assistance animal may not be permitted onto certain rides, Attractions or operational areas where the animal’s presence would create a safety risk to the patron, the animal, staff or other patrons.

Santa’s Wonderland will consider reasonable alternative arrangements where practicable.

Pets and non-accredited companion animals are not permitted unless expressly authorised by Santa’s Wonderland.

15. Smoking, Vaping and E-Cigarettes

Smoking, vaping and the use of e-cigarettes are permitted only in designated smoking areas and subject to applicable law.

Food and beverages must not be consumed in designated smoking areas where prohibited by applicable law.

16. Conduct Standards

Patrons must behave safely, respectfully and lawfully at all times.

Santa’s Wonderland may refuse entry to, remove, or refuse participation by any patron who:

  1. engages in vandalism, stealing or property damage;

  2. uses offensive, abusive, obscene, foul, profane, threatening or discriminatory language;

  3. behaves aggressively, offensively, dangerously or unlawfully;

  4. wears clothing or displays material that is offensive, threatening or inappropriate for a family event;

  5. queue jumps or interferes with queue management;

  6. fails to properly supervise children or dependants under their care;

  7. fails to follow safety instructions or operator instructions;

  8. interferes with staff, contractors, operators or emergency personnel;

  9. breaches these Terms;

  10. breaches any law, regulation, health order, direction or mandate; or

  11. otherwise creates a safety, security or operational risk.

17. Bag and Security Inspections

Santa’s Wonderland may request to inspect bags, containers, prams, personal items or other goods in a patron’s possession for safety and security purposes.

A patron may refuse a requested inspection. However, Santa’s Wonderland may refuse entry, require removal of items, or remove a patron from the event where an inspection is refused and Santa’s Wonderland reasonably considers the inspection necessary for safety or security.

18. Photography, CCTV and Recordings

CCTV, photography, video recording and audio recording may be used at Santa’s Wonderland.

Images, CCTV footage and recordings may constitute personal information and will be handled in accordance with the Santa’s Wonderland Privacy Policy: Privacy Policy.

Santa’s Wonderland may collect, use and disclose CCTV footage and recordings for:

  1. safety and security;

  2. crowd management;

  3. incident response and investigation;

  4. operational purposes;

  5. insurance and legal purposes; and

  6. compliance with law.

19. Promotional Photography and Filming

Santa’s Wonderland may take photographs, video recordings and audio recordings at the event for promotional, advertising, marketing, social media and general commercial purposes.

By entering Santa’s Wonderland, adult patrons consent to being photographed, filmed or recorded and to Santa’s Wonderland using those images or recordings for those purposes without compensation, unless the patron notifies Santa’s Wonderland that they do not wish to be the subject of close-up promotional photography or filming.

A parent or guardian may notify Santa’s Wonderland if they do not want a child in their care to be the subject of close-up promotional photography or filming.

Santa’s Wonderland will use reasonable endeavours to accommodate such requests. However, this does not apply to:

  1. CCTV and security recordings;

  2. recordings required for safety, incident response, operational, insurance or legal purposes;

  3. incidental appearance in crowd, background or general event imagery; or

  4. photography, filming or recording by third parties outside Santa’s Wonderland’s reasonable control.

20. Patron Photography and Recording

Patrons may take photographs or recordings for personal, non-commercial use, provided they do not interfere with safety, operations, staff, performers or other patrons.

Image recording devices must not be used in any bathroom, change room or other private area.

Santa’s Wonderland may restrict photography or recording in particular areas or Attractions for safety, privacy, operational or intellectual property reasons.

21. Intellectual Property

Santa’s Wonderland, including its name, logos, branding, event design, content, performances, displays, characters, signage and promotional material, is protected by copyright, trade mark and other intellectual property rights.

Patrons must not reproduce, copy, distribute, publish, commercially exploit or otherwise infringe Santa’s Wonderland’s intellectual property rights without prior written consent.

22. Vehicles and Personal Property

Vehicles are parked at the owner’s risk.

To the maximum extent permitted by law, Santa’s Wonderland is not responsible for loss of, theft of, or damage to any vehicle, accessory or contents in or on any vehicle.

Patrons are responsible for their own personal property brought to Santa’s Wonderland. Santa’s Wonderland is not responsible for lost, stolen or damaged personal property except to the extent required by law.

23. Incidents and Emergencies

Patrons must report any incident, injury, hazard, lost child, unsafe conduct or safety concern to Santa’s Wonderland staff immediately.

In an emergency, patrons must follow all instructions and directions from Santa’s Wonderland staff, operators, stewards, security personnel and emergency services.

24. Refusal of Entry and Removal

Santa’s Wonderland may refuse entry to, remove, or refuse participation by any patron where reasonably necessary for safety, security, legal or operational reasons.

Where a patron is refused entry or removed due to breach of these Terms, unsafe conduct, unlawful conduct, intoxication, failure to supervise children or failure to comply with staff directions, the patron may not be entitled to a refund, subject to any rights under the Australian Consumer Law.

25. Compliance with Laws and Government Directions

Conditions of entry are subject to applicable government and regulatory legislation, health orders, directions and mandates that require compliance by law.

Patrons must comply with all applicable legal requirements and any reasonable directions given by Santa’s Wonderland to support compliance.

26. Governing Law

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of the State of Victoria and courts competent to hear appeals from those courts.
